Jury Duty
All employees who serve on a jury are entitled to leave with pay for the period of absence required.
Full salary plus compensation for jury duty may be retained by the employee if a copy of the notice to serve on jury duty is presented.
Court Attendance
When an employee is subpoenaed to appear as a witness in a civil or criminal trial or appears as the prosecuting witness in a criminal proceeding, he may obtain civil leave with pay for the purpose of testifying.
Any witness fees, which the employee receives for testifying while on civil leave with pay shall be paid to Wake County. If an employee uses unused holiday leave, annual leave, or leave without pay for the purpose of testifying in a civil or criminal proceeding, he may retain any witness fees he receives.
When an employee attends a court proceeding as a witness in connection with his official duties, no leave is required.
Fees received as a witness while serving in an official capacity shall be turned in to the department for which the employee works. When an employee is required to attend court on a day he would normally have been off, the time is to be considered as working overtime and the employee will be paid according to Section 308, OVERTIME WORK.
When an employee attends a court hearing as a party or interested party to the proceedings and the case is not connected with his official duties, the employee must obtain unused holiday leave, annual leave, or leave without pay in accordance with County leave policy.
