506 Worker’s Compensation

Top  |   Previous  |   Next  |   Print

An employee who is accidentally injured on the job or who otherwise becomes eligible for worker's compensation shall request worker's compensation leave instead of using sick leave.

The employee will not be compensated for the first seven (7) days of disability, unless the disability continues for more than twenty-one (21) days. These twenty-one (21) days do not have to be consecutive and any workday in which the injured employee does not earn his full wages because of injury is counted as a day of disability, even though the employee may earn some wages.  After disability has continued more than twenty-one (21) days, the employee is entitled to receive compensation for the first seven (7) days.

All benefits received from the County during a period of absence on account of on-the-job accident disability shall be treated as a special accident disability benefit.

FMLA leave and Worker’s Compensation leave must be used concurrently, provided the reason for the absence is due to a qualifying serious illness or injury under FMLA.
