Coverage
The purpose of Wake County's Human Resources System is to ensure uniform human resources administration for all of the County's employees. The regulations in this manual are applicable to all officers and employees of Wake County with the exception of those so identified in Section 104, “Exclusions from Coverage.”
Local Government Employees Subject to the State Personnel Act
Chapter 126 of the North Carolina General Statutes, the State Personnel Act, provides for establishment of a system of human resources administration applicable to certain local employees paid entirely or in part from Federal funds. Local governing boards are authorized by that Chapter to establish human resources systems, which fully comply with the applicable Federal standards and may then remove such employees from the State system to their own system.
The provisions of Chapter 126 apply to employees of local offices of civil preparedness, which receive Federal grant-in-aid funds. Wake County local government employees are subject to the following provisions of the County human resources administration system:
Pay Administration
The County Manager has final authority on determining and processing all salary administration transactions. The County's current and future policies and regulations in this area supersede those of the State, which would otherwise apply.
Recruitment, Selection and Appointment
The County's system of recruitment, selection, and appointment supersedes that of the State, which would otherwise apply to those employees subject to the State Personnel Act.
Classification and Pay
The County's system of classification and pay supersedes that of the State which would otherwise apply to those employees subject to the State Personnel Act.
Discretion Permitted Local Governing Boards
When a board of county commissioners or governing body of a municipality adopts rules and regulations controlling annual leave, sick leave, hours of work, holidays, and the administration of the pay plan for local employees generally and these rules and regulations are filed with the State Personnel Director, the local rules will supersede the rules adopted by the State Personnel Commission as to the local employees otherwise subject to the provisions of Chapter 126.
The board of county commissioners of any county which shall establish and maintain a human resources system for all employees of the county subject to its jurisdiction, which system is found from time to time by the State Personnel Commission to be substantially equivalent to the system established under Chapter 126 for employees of local civil preparedness offices, may include employees of these local agencies within the terms of such system. Employees covered by that system shall be exempt from the provisions of Article 1 of Chapter 126.
Federal Standards for a Merit System of Human Resources Administration
Federal Standards have been developed to implement statutory and regulatory revisions requiring the establishment and maintenance of human resources standards on a merit basis in the administration of various grant-in-aid programs. Policies in this manual are in accordance with the Federal Standards in applying those provisions to positions in local government in North Carolina that are filled through a competitive system of selection.
