(1)By general statute, GS 160A-272, all leases out (County as lessor) of county property must be approved by the Board. However, Wake has special legislation authorizing lease of space in the WCOB without Board action. 1979 Sess. Laws ch. 275. This approval power could be delegated as indicated with a blanket resolution delegating authority as stated herein. Leases of property by the County (County as lessee) of one year duration or less and within budgeted amount may be authorized by staff. All others must be approved by the Board.
(1)Award of grants by the County (County as grantor) must be approved by the County Commissioners, but approval can take the form of a budget authorization and delegation to a county board or agency for award decisions. All Grants to the County (County as grantee) must be approved by the Board when received, in the form of a budget amendment. Grant applications, however, need not have prior Board approval unless the application requires the County to take some act or refrain from taking some act.
(1)The general rule is that if staff (rather than the Board) signed the original contract, any designated member of the staff may sign an amendment.
(1)For leases of 1 year or less, GSA must be contacted prior and will assist in obtaining needed space. GSA will initiate any contract documents and have review/approval authority. For leases of greater than 1 year, FDC must review and approve, along with GSA if GSA is responsible for any facility maintenance/monitoring.
(1)FDC (and County Attorney) are the only departments authorized to negotiate real estate transactions on the behalf of the county. FDC will initiate all contract documents for such transaction, including Board of Commissioners agenda item, if required.
